An Act to amend the Burial and Cremation Act 1964

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title and commencement

(1)

This Act may be cited as the Burial and Cremation Amendment Act 1968, and shall be read together with and deemed part of the Burial and Cremation Act 1964 (hereinafter referred to as the principal Act).

(2)

This Act shall come into force on the first day of January, nineteen hundred and sixty-nine.

2 Powers conferred on Minister

The principal Act is hereby amended in the manner indicated in the Schedule to this Act.

Section 2	By adding to the definition of the term “closing order” in subsection (1) the words “before the first day of January, nineteen hundred and sixty-nine, or a notice published under that paragraph after that date, or an Order in Council made under any corresponding former provision”.
Section 41	By omitting from subsection (1) the word “Governor-General”, and substituting the word “Minister”.
	By omitting from subsection (1) the words “Order in Council”, and substituting the words “notice in the Gazette”.
	By omitting from paragraph (a) of subsection (1) the words “order, not being less than six months from the date thereof”, and substituting the words “notice, not being less than six months from the date of the publication thereof”.
	By omitting from paragraph (b) of subsection (1) the words “such order” where that expression first occurs, and substituting the words “closing order”.
	By omitting from subsection (2) the word “Governor-General”, and substituting the word “Minister”.
	By omitting from subsection (2) the words “Order in Council”, and substituting the words “notice in the Gazette”.
	By omitting from subsection (3) the words “an Order in Council made”, and substituting the words “a notice published”.
Section 42	By omitting from subsection (1) the words “Order in Council that may be made by the Governor-General”, and substituting the words, “notice in the Gazette that may be published by the Minister”.
Section 43	By omitting from subsection (1) the words “Governor-General may by any closing order or by any subsequent Order in Council”, and substituting the words “Minister may by any closing order or by any subsequent notice in the Gazette”.
	By omitting, from subsection (1) the words “subsequent order”, and substituting the words “subsequent notice”.
	By omitting from subsection (3) the words “Governor-General may by Order in Council”, and substituting the words “Minister may by notice in the Gazette”.
	By omitting from subsection (3) the words “order made under subsection (1) of this section or this subsection, and may by the same or a subsequent order”, and substituting the words “notice published under subsection (1) of this section or this subsection and may by the same or a subsequent notice in the Gazette”.
Section 44	By omitting from subsection (1) the words “Governor-General may by any closing order or by any subsequent Order in Council”, and substituting the words “Minister may by any closing order or by any subsequent notice in the Gazette”.
	By omitting from subsection (1) the words “subsequent order”, and substituting the words “subsequent notice”.
	By omitting from subsection (2) the words “Governor-General may by Order in Council”, and substituting the words “Minister may by notice in the Gazette”.
	By omitting from the said subsection the words “order made under subsection (1) of this section or this subsection, and may by the same or a subsequent order”, and substituting the words “notice published under subsection (1) of this section or this subsection, and may by the same or a subsequent notice in the Gazette”.
	By omitting from subsection (3) the words “Governor-General may, if he thinks fit, in any order made”, and substituting the words “Minister may, if he thinks fit, in any notice published”.
	By omitting from the proviso to subsection (4) the words “Governor-General may by the closing order or any subsequent Order in Council”, and substituting the words “Minister may by the closing order or any subsequent notice in the Gazette”.
Section 45	By omitting from subsection (1) the words "Governor-General may by any closing order or by any subsequent Order in Council”, and substituting the words “Minister may by any closing order or by any subsequent notice in the Gazette.”
Section 45	By omitting from subsection (2) the word “through”, and substituting the word “to”.
Section 52	By omitting from subsection (3) the words “by the Governor-General”.
Section 53	By omitting from subsection (2) the words “An Order in Council”, and substituting the words “A notice in the Gazette”.
Section 53	By omitting from subsection (2) the words “copy of such Order in Council”, and substituting the words “copy of such notice”.
Section 59	By omitting from paragraph (d) the words “Order in Council”, and substituting the word “notice”.
