Analysis
An Act to amend the Broadcasting Corporation Act 1961
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Broadcasting Corporation Amendment Act 1970, and shall be read together with and deemed part of the Broadcasting Corporation Act 1961 (hereinafter referred to as the principal Act).
2 Powers of Corporation
Section 12 of the principal Act is hereby amended by omitting from subsection (3) (as amended by section 7(1) of the Decimal Currency Act 1964) the words “fifty thousand dollars”
, and substituting the figures “$100,000”
.
3 Salary of Director-General
(1)
The principal Act is hereby amended by inserting, after section 16, the following section:
“16a
“(1)
There shall be paid to the Director-General out of the Broadcasting Account a salary at such rate as the Governor-General, by Order in Council, from time to time determines.
“(2)
Any Order in Council under this section, and any provision of any such order, may be made so as to come into force on a date to be specified in that behalf in the order, being the date of the making of the order or any other date, whether before or after the date of the making of the order or the date of the commencement of this subsection.
“(3)
Every Order in Council under this section, and every provision of any such order, in respect of which no date is specified as aforesaid shall come into force on the date of the making of the order.
“(4)
The provisions of section 8 of the Regulations Act 1936 (which relates to the laying of regulations before Parliament) shall extend and apply to every Order in Council made under this section.”
(2)
Section 16 of the principal Act (as amended by section 4(1) of the Broadcasting Corporation Amendment Act 1967) is hereby amended by repealing subsection (2a).
(3)
All payments by way of salary to the Director-General of Broadcasting, in excess of the amounts appropriated by Parliament for the purpose, made before the commencement of section 16a of the principal Act (as inserted by subsection (1) of this section), and all such payments made after the commencement of the said section 16a and before the coming into force of the first Order in Council made under the said section 16a, are hereby validated and declared to have been lawfully made.
This Act is administered in the New Zealand Broadcasting Corporation.
