An Act to amend the Animals Protection Act 1960
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title and commencement
(1)
This Act may be cited as the Animals Protection Amendment Act 1971, and shall be read together with and deemed part of the Animals Protection Act 1960 (hereinafter referred to as the principal Act.)
(2)
This Act shall come into force on the 1st day of January 1972.
2 Interpretation
Section 2 of the principal Act is hereby amended by inserting, in its appropriate alphabetical order, the following definition:
“‘Bovine animal’ means any bull, cow, ox, steer, heifer, or calf:”.
3 Offences of cruelty
(1)
Section 3 of the principal Act is hereby amended by inserting in paragraph (g), after the word “by”
, the words “or under the supervision of”
.
(2)
Section 3 of the principal Act is hereby amended by repealing paragraph (h).
(3)
Section 3 of the principal Act is hereby amended by repealing paragraph (m), and substituting the following paragraphs:
“(m)
Docks, or causes or procures to be docked, the tail of any horse, unless the docking is performed by or under the supervision of a veterinary surgeon or veterinary practitioner; or
“(ma)
Performs, or causes or procures to be performed, on the tail of any horse the operation known as knicking; or
“(mb)
Docks or causes or procures to be docked, the tail of any bovine animal, unless the docking is performed—
“(i)
By or under the supervision of a veterinary surgeon or veterinary practitioner; or
“(ii)
In accordance with any method prescribed by regulations made under this Act; or”.
(4)
Section 3 of the principal Act is hereby amended by repealing paragraph (n).
(5)
Section 3 of the principal Act is hereby amended by adding the following paragraphs:
“(x)
Castrates, or causes or procures to be castrated,—
“(i)
Any bovine animal, sheep, goat, or pig, over the age of 9 months; or
“(ii)
Any horse, cat, dog, mule, or ass, of any age,—
unless the castration is performed by or under the supervision of a veterinary surgeon or veterinary practitioner; or
“(y)
Dehorns, or causes or procures to be dehorned, any animal over the age of 20 months, unless during the whole course of the operation the animal is under the influence of a general or local anaesthetic of sufficient power to prevent its feeling pain; or
“(z)
Being a veterinary surgeon or veterinary practitioner or a person acting under the supervision of such a surgeon or practitioner—
“(i)
Spays any cat or dog; or
“(ii)
Docks the tail of any horse; or
“(iii)
Castrates any bovine animal, sheep, goat, or pig, over the age of 9 months; or
“(iv)
Castrates any horse, cat, dog, mule, or ass, of any age,—
unless during the whole course of the operation the animal is under the influence of a general or local anaesthetic of sufficient power to prevent its feeling pain.”
(6)
Section 3 of the principal Act is hereby further amended by adding to paragraph (w) the word “; or”
.
4 Exemptions
Section 19 of the principal Act is hereby amended by omitting from paragraph (a) of subsection (1) the words “dehorning of cattle or the castration,”
.
5 Regulations
Section 20 of the principal Act is hereby amended by inserting in subsection (2), after paragraph (b), the following paragraph:
“(ba)
Prescribing methods by which the tail of any bovine animal or of any specified class or age of bovine animal may be docked:”.
This Act is administered in the Department of Agriculture.
