An Act to amend the Margarine Act 1908

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title

This Act may be cited as the Margarine Amendment Act 1972, and shall be read together with and deemed part of the Margarine Act 1908 (hereinafter referred to as the principal Act).

2 Interpretation

Section 2 of the principal Act is hereby amended by omitting the definition of the term “margarine”, and substituting the following definitions:

“‘Margarine’ includes all substances (other than butterfat or milk) whether compound or not, prepared or manufactured from any form of animal fats, or of animal or vegetable oils, and capable of being used as a substitute for butter:

“‘Polyunsaturated’, in relation to margarine or other substances consisting of fats, means that the proportion of cis-methylene interrupted polyunsaturated fatty acids is at least 40 percent of the total fat and the proportion of saturated fatty acids does not exceed 20 percent of the total fat.”

3 Who may prepare margarine

Section 3 of the principal Act (as amended by section 7(1) of the Decimal Currency Act 1964) is hereby amended by omitting from subsection (3) the words “two dollars”, and substituting the expression “$5”.

4 Illegal acts

(1)

Section 4 of the principal Act is hereby amended by inserting in paragraph (a), and also in paragraph (b), after the word “margarine”, the words “, other than polyunsaturated margarine,”.

(2)

Section 4 of the principal Act is hereby further amended by adding, as subsection (2), the following subsection:

“(2)

Nothing in this section or in any regulations made under section 10 of this Act shall make it unlawful to include milk fat in polyunsaturated margarine.”

5 Packages, how branded

Section 5 of the principal Act is hereby amended by inserting, after the words “containing margarine”, the words “, other than polyunsaturated margarine,”.

6 Marking of wrappers

Section 7 of the principal Act is hereby amended—

(a)

By inserting in subsection (1), after the words “sells margarine”, the words “, other than polyunsaturated margarine,”:

(b)

By omitting from subsection (2) (as amended by section 7(1) of the Decimal Currency Act 1964) the words “two dollars”, and substituting the expression “$20”.

7 Regulations

Section 10 of the principal Act (as amended by section 7(1) of the Decimal Currency Act 1964) is hereby amended by omitting from subsection (2) the words “one hundred dollars”, and substituting the expression “$500”.

This Act is administered in the Ministry of Agriculture and Fisheries.
