Contents
An Act to amend the Land Act 1948
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title and commencement
(1)
This Act may be cited as the Land Amendment Act 1972, and shall be read together with and deemed part of the Land Act 1948 (hereinafter referred to as the principal Act).
(2)
This Act shall come into force on the 1st day of January 1973.
2 Standard measurements of length and area
The principal Act is hereby amended by repealing section 35, and substituting the following section:
“35
“(1)
All measurements of length in surveys and on plans of land affecting titles under the Land Transfer Act 1952 shall be made and expressed in metres and decimals of the metre; and measurements of area in such surveys and on such plans shall be expressed in hectares and decimals of a hectare, or, where the area is less than 1 hectare, shall be expressed in square metres.
“(2)
For the purpose of ensuring the accuracy and uniformity of those measurements, there shall be kept in the custody of the Minister of Science a standard or standards of a length of a metre and decimals of a metre, properly compared and uniform with the standard measurement of that unit for the time being accepted by the States adhering to the Convention of the Metre 1875, and preserved by the International Bureau of Weights and Measures, Sevres, France. Those standards shall be the legal reference for all surveys of land in New Zealand, notwithstanding the provisions of any other Act.”
3 Conversion to metric system
(1)
The principal Act is hereby further amended—
(a)
By omitting from subsection (1) of section 58 the words “sixty-six feet”
, and substituting the words “20 metres”
:
(b)
By omitting from paragraph (b) of the same subsection the words “twenty acres”
, and substituting the words “8 hectares”
:
(c)
By omitting from the same subsection the words “ten feet”
wherever they occur, and substituting in each case the words “3 metres”
:
(d)
By omitting from section 110 the words “one mile of a homestead but within one-quarter of a mile”
, and substituting the words “2 kilometres of a homestead but within 500 metres”
.
(2)
Until the Mining Act 1971 comes into force, section 59 of the principal Act shall have effect as if it had been amended—
(a)
By omitting from paragraph (a) of subsection (3) (as amended by section 6(a) of the Land Amendment Act 1950) the words “one hundred feet”
, and substituting the words “30 metres”

(b)
By omitting from paragraph (b) of subsection (3) the words “half an acre”
, and substituting the words “2,000 square metres”
:
(c)
By omitting from paragraph (c) of subsection (3) (as amended by section 6(b) of the Land Amendment Act 1950) the words “one hundred feet”
, and substituting the words “30 metres”
.
