An Act to amend the Land Transfer Act 1952
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Land Transfer Amendment Act 1972, and shall be read together with and deemed part of the Land Transfer Act 1952 (hereinafter referred to as the principal Act).
2 Caveat may be withdrawn
Section 147 of the principal Act is hereby amended by adding the following proviso:
“Provided that where a registrable instrument purporting to give effect to the estate or interest of the caveator is presented to the Registrar for registration immediately following a withdrawal of a caveat previously lodged to protect that estate or interest, the authority of any agent executing the withdrawal on behalf of the caveator need not be in writing.”
3 Plans to be deposited in certain cases
Section 167 of the principal Act is hereby amended—
(a)
By omitting from subsection (1) the words “and shall be verified by the statutory declaration of a registered surveyor in such form as the regulations prescribe”
:
(b)
By omitting from the proviso to subsection (1) (as added by section 12 of the Land Transfer Amendment Act 1966) the words “and verified as aforesaid”
.
