An Act to amend the National Parks Act 1952
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the National Parks Amendment Act 1972, and shall be read together with and deemed part of the National Parks Act 1952 (hereinafter referred to as the principal Act).
2 Parks to be maintained in natural state and public to have right of entry
Section 3 of the principal Act is hereby amended by inserting in subsection (2), after paragraph (b), the following paragraph:
“(ba)
Sites and objects of archaeological and historical interest shall, as far as possible, be preserved:”.
3 Banking of money by the Authority
The principal Act is hereby further amended by inserting, after section 6a (as inserted by section 3 of the National Parks Amendment Act 1968), the following section:
“6b
“(1)
The Authority may establish a bank account in any bank, and pay into that account any donations received by it together with any subsidies received in respect of such donations.
“(2)
The account shall be called ‘The National Parks Authority Account’, and shall be operated on by such persons and in such manner as the Authority from time to time by resolution decides.
“(3)
All such money of the Authority shall, within 7 days after it comes into the hands of any such person or of any officer or employee of the Authority, be paid to the credit of the Authority in the account so established.
“(4)
The Authority may invest any money held in that bank account and not immediately required for expenditure by the Authority in any manner in which trustees are for the time being authorised to invest trust funds.
“(5)
The provisions of section 48 and subsection (1) of section 49 of this Act (relating to the audit of accounts and the preparation of an annual statement of accounts), as far as they are applicable and with the necessary modifications, shall apply to any account established under the provisions of this section.
“(6)
The Authority may, without further authority than this section, apply money held in any account established under the provisions of this section as follows:
“(a)
Money received as a donation for any particular purpose may be applied for that purpose:
“(b)
Any other money may be applied in the administration of this Act or in improving any Park or in carrying out in respect of any Park the objects of this Act.”
This Act is administered in the Department of Lands and Survey.
