An Act to amend the Public Works Act 1928

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title

This Act may be cited as the Public Works Amendment Act 1972, and shall be read together with and deemed part of the Public Works Act 1928 (hereinafter referred to as the principal Act).

2 Procedure for making railway

Section 216 of the principal Act is hereby amended by inserting, after paragraph (b) of subsection (1), the following paragraph:

“(ba)

As soon as practicable after the publication of any such Proclamation, the Minister shall give every owner and registered lessee of land required to be so occupied, so far as they can be ascertained, notice of the right conferred on the Minister to enter on the land for the construction of the railway:

“Provided that such notice shall be given in respect of Maori land only to such owners as have been nominated for the purpose, at the request of the Minister, by the Registrar of the Maori Land Court, who shall nominate all owners whose current addresses are known to him:”.

3 Metric conversions

(1)

The enactments specified in the Schedule to this Act are hereby amended in the manner indicated in that Schedule.

(2)

Notwithstanding anything in subsection (1) of this section, anything validly done under any enactment amended by that subsection shall not be invalidated by reason of any such amendment.

(3)

The following enactments are hereby consequentially repealed:

(a)

Subsection (1) of section 31 of the Public Works Amendment Act 1948:

(b)

Section 20 of the Public Works Amendment Act 1960.
