An Act to amend the Mining Act 1971
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Mining Amendment Act 1973, and shall be read together with and deemed part of the Mining Act 1971 (hereinafter referred to as the principal Act).
2 Interpretation
Section 5 of the principal Act is hereby amended by inserting in subsection (1), after the definition of the term “machinery”
, the following definition:
“‘Magistrate’s Court’ means a Magistrate’s Court which is for the time being exercising civil jurisdiction:”.
3 Practical experience required
The principal Act is hereby further amended by repealing section 171, and substituting the following section:
“171
A mine manager’s certificate shall not be granted to any person unless, in addition to passing the prescribed examination, he satisfies the Board that he is not less than 21 years of age and has been employed in the underground workings of a mine, or of a tunnel within the meaning of the Quarries Act 1944 if the workings were in the opinion of the Board similar to the workings of a mine, for a period or periods totalling—
“(a)
If he holds a certificate of competency as a mine manager under the Coal Mines Act 1925, not less than 1 year of which not more than 6 months was in a tunnel:
“(b)
If he is the holder of a degree in Mineral Technology (Mining) conferred by the University of Otago or is the holder of a degree or diploma in mining engineering conferred by any other university or school of mines, not less than 3 years (including any periods served in the course of study) at least 1 year of which was at the face of the tunnel or mine and not more than 6 months of which was in a tunnel:
“(c)
In every other case, not less than 3 years at the face of the tunnel or mine of which not more than 6 months was in a tunnel.”
This Act is administered in the Mines Department.
