An Act to amend the Marine Pollution Act 1974
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Marine Pollution Amendment Act 1974, and shall be read together with and deemed part of the Marine Pollution Act 1974 (hereinafter referred to as the principal Act).
2 Meaning of “pollution damage”
Section 2(1) of the principal Act is hereby amended by inserting in the definition of the expression “pollution damage”
, after the words “any pollutant”
, the words “, or which is attributable to the dumping of waste or other matter,”
.
3 Discharge of oil or pollutant into waters outside New Zealand waters
Section 4 of the principal Act is hereby amended—
(a)
By inserting in subsection (1), after the words “New Zealand waters”
, the words “, or into any such part of the sea from a floating platform or from any ship (whether a New Zealand ship or not), being a platform or ship used in connection with any operations for the exploration of the seabed or subsoil of the continental shelf or the exploitation of the natural resources thereof,”

(b)
By inserting in subsection (1), after the words “master of the ship”
, the words “, or, in the case of a discharge or escape from a floating platform, the owner of the platform or the person carrying on the operations or the person in charge of the operations,”

(c)
By inserting in subsection (3), after the words “specified ship”
, the words “or to particular classes of floating platforms or to any specified floating platform”
.
This Act is administered in the Ministry of Transport.
