An Act to amend the Police Offences Act 1927
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Police Offences Amendment Act 1974, and shall be read together with and deemed part of the Police Offences Act 1927 (hereinafter referred to as the principal Act).
2 Assaults on constables, prison officers, and traffic officers
(1)
The principal Act is hereby amended by inserting, after section 77, the following section:
“77a
“(1)
Every person commits an offence and is liable to imprisonment for a term not exceeding 6 months or to a fine not exceeding $400 who assaults any constable in the execution of his duty or any officer of a penal institution in the execution of his duty or any traffic officer in the execution of his duty.
“(2)
Nothing in section 66 of the Summary Proceedings Act 1957 (which relates to the right of a defendant to elect trial by jury) shall apply with respect to any offence charged under this section.
“(3)
For the purposes of this section, the terms ‘officer’ and ’penal institution’ have the meanings assigned to them in section 2 of the Penal Institutions Act 1954 and the term ‘traffic officer’ has the meaning assigned to it by section 2(1) of the Transport Act 1962.”
(2)
Section 77 of the principal Act is hereby amended by omitting the words “or assaults”
and also the word “assault”
.
(3)
Section 79 of the principal Act (as substituted by section 213 of the Summary Proceedings Act 1957) is hereby amended by omitting from subsection (3) the words “and 77”
, and substituting the words “77, and 77a”
.
