This order is made under section 4(1) and (1B) of the Misuse of Drugs Act 1975—
(a)
on the advice and with the consent of the Executive Council; and
(b)
on the recommendation of the Minister of Health made after complying with section 4B of that Act.
Order
1 Title
This order is the Misuse of Drugs (Classification and Presumption of Supply) Order 2022.
2 Commencement
This order comes into force on a date appointed by the Governor-General by Order in Council made under section 4A(1) of the Misuse of Drugs Act 1975.
Clause 2: clauses 1–4, 5(1) (except to the extent that it relates to fentanyl only) and (2), 6(1), and 7–8 brought into force, on 15 December 2022, by clause 2(1) of the Misuse of Drugs (Classification and Presumption of Supply) Commencement Order 2022 (SL 2022/292).
Clause 2: clauses 5(1) (to the extent that it relates to fentanyl only) and (3), and 6(3) brought into force, on 1 July 2023, by clause 2(2) of the Misuse of Drugs (Classification and Presumption of Supply) Commencement Order 2022 (SL 2022/292).
Clause 2: clause 6(2) brought into force, on 1 October 2023, by clause 2(3) of the Misuse of Drugs (Classification and Presumption of Supply) Commencement Order 2022 (SL 2022/292).
3 Amendments to Misuse of Drugs Act 1975
Clauses 4 to 8 amend the Misuse of Drugs Act 1975.

1 General
This is a consolidation of the Misuse of Drugs (Classification and Presumption of Supply) Order 2022 that incorporates the amendments made to the legislation so that it shows the law as at its stated date.
2 Legal status
A consolidation is taken to correctly state, as at its stated date, the law enacted or made by the legislation consolidated and by the amendments. This presumption applies unless the contrary is shown.
