An Act to amend the Electric Linemen Act 1959

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title

This Act may be cited as the Electric Linemen Amendment Act 1975, and shall be read together with and deemed part of the Electric Linemen Act 1959 (hereinafter referred to as the principal Act).

2 Minor penalties and requirements for further training

The principal Act is hereby amended by inserting, after section 18, the following section:

“18a

Where the Committee is satisfied in any case that the holder of a certificate of competency has failed to carry out his duties as an electric lineman in a safe, careful, or proper manner, the Committee may—

“(a)

Prohibit the holder from exercising control over any trainee lineman for a specified period not exceeding 6 months and endorse his certificate to that effect; or

“(b)

Order the holder to undergo a period of retraining not exceeding 12 months and suspend his certificate until that period of training has been completed to the satisfaction of the Committee; or

“(c)

Require the holder to resit, in whole or in part, any examinations which may be prescribed for certification by regulations under this Act, and suspend his certificate until he has sat and passed any such examinations.”

3 Appeals from Committee

(1)

Section 21(1) of the principal Act is hereby amended by adding the words “or any decision of the Committee under section 18a of this Act”.

(2)

Section 21 of the principal Act is hereby further amended by repealing subsection (3), and substituting the following subsection:

“(3)

At the hearing of any appeal the Board of Appeal may—

“(a)

Confirm the decision of the Committee; or

“(b)

Reverse the decision of the Committee; or

“(c)

In the case of the revocation of a certificate of competency or the imposition of any penalty by the Committee under section 18a of this Act, impose a penalty under that section less severe than that imposed by the Committee.”

This Act is administered in the New Zealand Electricity Department.
