An Act to amend the Mental Health Act 1969
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Mental Health Amendment Act 1976, and shall be read together with and deemed part of the Mental Health Act 1969 (hereinafter referred to as the principal Act).
2 Duration of reception order
Section 28 of the principal Act is hereby amended by adding the following subsection:
“(5)
Upon the lapsing of a reception order pursuant to paragraph (b) or paragraph (c) or paragraph (d) of subsection (4) of this section, the patient in respect of whom the reception order was made shall, for the purposes of Part VII of this Act, be deemed to have been discharged.”
3 Fees of medical practitioners
(1)
Section 119 of the principal Act is hereby amended—
(a)
By omitting from subsection (1) the words “the Magistrate directs in accordance with any scale”
, and substituting the words “may be”
:
(b)
By omitting from subsection (2) the words “in accordance with the said scale”
.
(2)
The said section 119 is hereby further amended by adding the following subsection:
“(5)
Any regulations made under section 126 of this Act may, so far as they relate to fees prescribed for any matter undertaken for the purposes of this section, apply in respect of such matter undertaken on or after such date as may be specified in the regulations, which may be a date before or after or the same as the date on which the regulations were made.”
This Act is administered in the Department of Health.
