An Act to amend the Electricity Act 1968
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Electricity Amendment Act (No. 2) 1976, and shall be read together with and deemed part of the Electricity Act 1968 (herein after referred to as the principal Act).
2 Generation of electricity by means of water power
Section 25 of the principal Act is hereby amended by repealing subsection (4), and substituting the following subsections:
“(4)
Where authorisation is given under this section for the generation, otherwise than by a public authority, of electricity by the use of water, the Minister may impose a rental and, in determining the amount of the rental, the Minister shall take into account the cost of equivalent alternative sources of energy.
“(5)
Any rental imposed under subsection (4) of this section shall be subject to review at intervals to be determined by the Minister.
“(6)
In giving any consent under this section, the Minister may impose such conditions as he thinks fit on the generation of the electricity and its subsequent use.”
This Act is administered in the New Zealand Electricity Department.
