An Act to amend the Criminal Justice Act 1954

Be it enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title

This Act may be cited as the Criminal Justice Amendment Act 1976, and shall be read together with and deemed part of the Criminal Justice Act 1954 (hereinafter referred to as the principal Act).

2 Publication of names of persons accused and convicted of offences

(1)

Section 45b of the principal Act (as inserted by section 17(1) of the Criminal Justice Amendment Act 1975) is hereby repealed.

(2)

Section 45c of the principal Act (as inserted by section 17(1) of the Criminal Justice Amendment Act 1975) is hereby amended by inserting in subsection (2), after the words “the person”, the words “accused or”.

(3)

Section 45d of the principal Act (as inserted by section 17(1) of the Criminal Justice Amendment Act 1975) is hereby amended—

By omitting the words “section 45b or”:

By inserting, after the words “this Act”, the words “, nor an order made under section 46 of this Act,”.

(4)

Section 46(1) of the principal Act (as amended by section 17(2)(a) of the Criminal Justice Amendment Act 1975) is hereby amended by inserting, after the words “the person”, the words “accused or”.

(5)

Section 61 of the Transport Act 1962 (as amended by section 17(3) of the Criminal Justice Amendment Act 1975) is hereby amended by omitting the words “persons convicted of offences”, and substituting the words “accused persons or of reports or accounts of their arrest, trial, conviction, or release on probation”.

(6)

Section 17 of the Criminal Justice Amendment Act 1975 is hereby amended by repealing subsection (2)(a) and subsection (3).
