Contents

An Act to amend the University of Waikato Act 1963

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title

This Act may be cited as the University of Waikato Amendment Act 1977, and shall be read together with and deemed part of the University of Waikato Act 1963 (hereinafter referred to as the principal Act).

2 Interpretation

(1)

Section 2 of the principal Act is hereby amended by repealing the definition of the term “Professorial Board”.

(2)

The said section 2 is hereby further amended by inserting, in their appropriate alphabetical order, the following definitions:

“‘Academic Board’ means the Academic Board of the University constituted by section 30 of this Act:

“‘Board of Studies’ means a Board of Studies constituted in respect of a School of Studies under section 36a(2) of this Act:

“‘Dean’ means the Dean of a School of Studies, appointed under section 36a(3) of this Act:

“‘School of Studies’ means a School of Studies so declared under section 36a(1) of this Act:

“‘Sub-professorial staff’ means those members of the academic staff of the University who are not proffessors:”.

(3)

The principal Act is hereby consequentially amended by omitting the expression “Professorial Board”, wherever it occurs, and substituting, in each case, the expression “Academic Board”.

3 Constitution of Council

(1)

Section 6 of the principal Act is hereby amended by repealing subsection (2), and substituting the following subsections:

“(2)

The Council shall comprise:

“(a)

Four members, to be appointed by the Governor-General:

“(b)

Two members, to be appointed by the Academic Board, who shall, at the time of their appointment, be members of the Academic Board:

“(c)

Two members, to be elected by the professors from among themselves:

“(d)

Two members, to be elected by the sub-professorial staff, who shall, at the time of their election, be both members of the sub-professorial staff and members of the Academic Board; and for the purposes of this paragraph a person shall be deemed to become a member of the Academic Board upon his being elected as such:

“(e)

One member, to be elected by those students of the University who are members of Boards of Studies, who shall, at the time of his election, be both a member of the Academic Board and enrolled as a candidate for a degree or other academic qualification of the University:

“(f)

One member, to be appointed by such association or organisation representing students of the University (whether or not it also represents persons who are not students of the University) as the Council from time to time specifies, who shall, at the time of his appointment, be the President or a Vice-President of the association or organisation and be either enrolled as a candidate for a degree or other qualification of the University or exempted by the Council from so enrolling:

“(g)

Two members, to be elected by those full-time members of the staff of the University who are not academic staff from among themselves:

“(h)

One member, to be elected in accordance with subsection (3) of this section by the Governing bodies of all State secondary schools, technical schools, and combined schools, and of such registered private secondary schools as the Council may from time to time determine, in the education district of South Auckland as it was constituted on the 1st day of January 1964:

“(i)

One member, to be appointed by the Hamilton City Council:

“(j)

The Vice-Chancellor or, while there is no Vice-Chancellor in office or during the absence or incapacity of the Vice-Chancellor,—

(i)

The Acting Vice-Chancellor; or

(ii)

While there is no Acting Vice-Chancellor the Chairman of the Academic Board:

“(k)

Three members, to be elected by the Court of Convocation of the University, who shall, at the time of their election, be graduates of any university in New Zealand or elsewhere:

“(l)

The Principal for the time being of the Hamilton Teachers College:

“(m)

The Principal for the time being of the Waikato Technical Institute:

“(n)

Such further members not exceeding 3 as the Council may from time to time appoint.

“(2a)

Where any member of the Council appointed or elected pursuant to subsection (2)(b) or subsection (2)(c) of this section is Acting Vice-Chancellor there may be appointed or elected, in his place, in the same manner as he was appointed or elected, a deputy member of the Council.”

4 Term of office

(1)

Section 8 of the principal Act is hereby amended by repealing subsection (1), and substituting the following subsections:

“(1)

Except as otherwise provided in this Act, the terms of office of elected and appointed members of the Council shall be as follows:

“(a)

Three years in the case of every member elected or appointed pursuant to paragraph (a), (b), (c), (h), (i) or paragraph (k) of section 6(2) of this Act:

“(b)

Two years in the case of every member elected pursuant to paragraph (d) or paragraph (g) of section 6(2) of this Act:

“(c)

One year in the case of a member elected pursuant to section 6(2)(e) of this Act:

“(d)

Either one year or until he ceases to hold the requisite qualifications, whichever may be the sooner, in the case of a member elected pursuant to section 6(2)(f) of this Act:

“(e)

Three years, or such lesser period as the Council may specify at the time of his appointment, in the case of a member appointed pursuant to section 6(2)(n) of this Act.

“(1a)

Subject to section 6(5) and section 10 of this Act, every member of the Council whose term of office expires shall be eligible for reappointment or re-election.”.

(2)

Section 8(2) of the principal Act is hereby amended by omitting the words “The election”, and substituting the words “Subject to subsection (3a) of this section, the election”.

(3)

Section 8(3) of the principal Act is hereby amended—

(a)

By omitting the word “Except”, and substituting the words “Subject to subsection (3a) of this section, except”:

(b)

By repealing the proviso.

(4)

The said section 8 is hereby further amended by inserting, after subsection (3), the following subsection:

“(3a)

The election of the member of the Council, elected pursuant to section 6(2)(e) of this Act shall be held no later than the third Monday in June each year; and each such member shall come into office on the 1st day of July next following his election.”

(5)

Section 8(5) of the principal Act is hereby amended by omitting the expression “paragraph (h) of subsection (2) of section 6”, and substituting the expression “section 6(2)(n)”.

5 Employees as Council members

(1)

The principal Act is hereby further amended by repealing section 9, and substituting the following section:

“9

“(1)

No person in the employment of the University who, in any financial year, receives from the University in respect of that employment an amount in excess of such amount as the Minister of Education from time to time determines shall be eligible for office as a member of the Council otherwise than pursuant to paragraph (b), (c), (d), (g), or paragraph (j) of section 6(2) of this Act.

“(2)

In the calculation, for the purposes of subsection (1) of this section, of the amount paid to a person by the University during any financial year, no account shall be taken of any fee or stipend, determined in accordance with section 18(c) of this Act, paid to him in respect of his acting, at the request of the Council, as an examiner, assessor, or moderator, in any subject or examination.”.

(2)

The following enactments are hereby consequentially repealed:

(a)

Section 3 of the University of Waikato Amendment Act 1966:

(b)

So much of the Second Schedule to the University of Albany Amendment Act 1973 as relates to section 9 of the principal Act.

6 Admission of students

(1)

Section 24(2) of the principal Act is hereby amended by repealing paragraph (f), and substituting the following paragraph:

“(f)

Insufficiency of accommodation or of teachers in the University or in a faculty, department, class, or course of the University:

“Provided that the Council shall exercise its power under this paragraph in accordance with criteria and procedures prescribed from time to time by it after consultation with the University Grants Committee.”.

(2)

Section 24(4) of the principal Act is hereby consequentially amended by omitting the words “or department of the University shall be deemed to exist, and the maximum number of students who may be admitted to any course or class”, and substituting the words “, department, class, or course of the University shall be deemed to exist, and the maximum number of students who may be admitted to any faculty, department, course, or class”.

7 Academic Board

The principal Act is hereby further amended by repealing section 30, and substituting the following sections:

“30 Constitution of Academic Board

“(1)

There shall be an Academic Board of the University of Waikato.

“(2)

The Academic Board shall comprise:

“(a)

The Vice-Chancellor:

“(b)

The Assistant to the Vice-Chancellor:

“(c)

The Deans of the University:

“(d)

The professors of the University:

“(e)

Those heads of academic departments of the University who are not professors:

“(f)

From each Board of Studies one member, to be elected by those members of that Board of Studies who are members of the sub-professorial staff from among themselves:

“(g)

From each Board of Studies one member, to be elected by those members of that Board of Studies who are enrolled as candidates in subjects taught in an academic department forming part of the School of Studies for academic matters affecting which that Board of Studies is responsible and who are not members of the academic staff, from among themselves:

“(h)

The Librarian of the University:

“(i)

The Liaison Officer of the University:

“(j)

The Principal of the Hamilton Teachers College:

“(k)

As many and such other members as the Council may, on the recommendation of the Academic Board, appoint.

“30a Term of office of members of Academic Board

“(1)

Subject to section 30b of this Act, an elected member of the Academic Board shall come into office on the 1st day of July after the date of his election in the case of a member elected under section 30(2)(g) of this Act, and on the 1st day of January following the date of his election in every other case.

“(2)

Subject to section 30b of this Act, the following provisions shall apply to elected and appointed members of the Academic Board:

“(a)

Every member elected under section 30(2)(f) of this Act shall hold office for 2 years:

“(b)

Every member elected under section 30(2)(g) of this Act shall hold office for one year:

“(c)

Every member appointed under section 30(2)(k) of this Act shall hold office for 2 years or such lesser period as the Council, on the recommendation of the Academic Board, may specify at the time of his appointment.

“30b Casual vacancies in Academic Board

The provisions of section 11 of this Act with respect to casual vacancies in the Council shall, with the necessary modifications, apply with respect to the creation of casual vacancies in the membership of the Academic Board:

Provided the Council shall not be obliged to fill any vacancy that relates to an appointed member.”

8 Schools of Studies and Boards of Studies

The principal Act is hereby further amended by inserting, after section 36, the following heading and section:

“Schools of Studies

“36a

“(1)

The Council may from time to time, on the recommendation of the Academic Board, declare that specified academic departments of the University together constitute a School of Studies; and on the like recommendation may revoke or vary any such declaration.

“(2)

The Council may from time to time, on the recommendation of the Academic Board, constitute a Board of Studies in respect of any School of Studies or dissolve or reconstitute any existing Board of Studies; and every Board of Studies shall be responsible to the Academic Board for academic matters affecting the School of Studies in respect of which it is constituted.

“(3)

The Council may from time to time, for such term and upon and subject to such conditions as it thinks fit, appoint one member of a Board of Studies to be the Dean of the School of Studies for academic matters affecting which that Board of Studies is responsible; and the Dean for the time being of that School of Studies shall act as the Chairman of that Board of Studies.”
