An Act to amend the Medical Practitioners Act 1968
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Medical Practitioners Amendment Act 1978, and shall be read together with and deemed part of the Medical Practitioners Act 1968 (hereinafter referred to as the principal Act).
2 Divisional Disciplinary Committees
(1)
Section 41 of the principal Act is hereby amended by omitting from subsection (1) the word “appoint”
, and substituting the words “resolve that there shall be”
.
(2)
The said section 41 is hereby further amended by repealing subsection (2), and substituting the following subsections:
“(2)
In the case of the Auckland, Wellington, Canterbury, and Otago Divisions, or of any group that includes any of those Divisions, the Divisional Disciplinary Committee shall consist of—
“(a)
Six registered medical practitioners who shall be appointed by the Council of the Association; and
“(b)
One person, not being a medical practitioner, who shall be appointed by the Minister;—
and 4 of those members shall form a quorum.
“(2a)
In every case other than those provided for by subsection (2) of this section, the Divisional Disciplinary Committee shall consist of—
“(a)
Three registered medical practitioners who shall be appointed by the Council of the Association; and
“(b)
One person, not being a medical practitioner, who shall be appointed by the Minister;—
and 2 of those members shall form a quorum.”
(3)
The said section 41 is hereby further amended—
(a)
By inserting in subsection (4), after the words “Divisional Disciplinary Committee”
, the words “appointed by the Council”
:
(b)
By adding to that subsection the words “appointed by it”
.
