An Act to amend the Animals Protection Act 1960

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title

This Act may be cited as the Animals Protection Amendment Act 1978, and shall be read together with and deemed part of the Animals Protection Act 1960 (hereinafter referred to as the principal Act).

2 Court may order that certain animals be forfeited to the Crown

(1)

The principal Act is hereby amended by inserting, after section 16, the following section:

“16a

“(1)

Where the owner of any animal is convicted of an offence against this Act in respect of that animal, the Court may, if it thinks it desirable for the protection of the animal and in addition to or in substitution for any other penalty, order that the animal be forfeited to the Crown or to a society established for the prevention of cruelty to animals.

“(2)

Any animal forfeited to the Crown pursuant to this section may be sold or otherwise disposed of, as the Minister thinks fit.

“(3)

Any animal forfeited to a society pursuant to this section may be sold or otherwise disposed of, as the society thinks fit.”

(2)

Section 10(4) of the principal Act is hereby consequentially amended by inserting, after the words “until such time as”, the words “the animal is forfeited to the Crown or to a society pursuant to section 16a of this Act or”.

3 Fines increased

The principal Act (as amended by section 7 of the Decimal Currency Act 1964) is hereby further amended—

(a)

By omitting from section 3 the words “two hundred dollars”, and substituting the expression “$1,000”:

By omitting from section 4 the words “one thousand dollars”, and substituting the expression “$2,000”:

(c)

By omitting from section 6(2) the words “one hundred dollars”, and substituting the expression “$200”:

(d)

By omitting from section 7(3) the words “two hundred dollars”, and substituting the expression “$1,000”:

(e)

By omitting from section 8(3) the words “twenty dollars”, and substituting the expression “$50”:

(f)

By omitting from section 10(7) the words “forty dollars”, and substituting the expression “$100”:

(g)

By omitting from section 16(3) the words “two hundred dollars”, and substituting the expression “$1,000”:

(h)

By omitting from section 17(2) the words “forty dollars”, and substituting the expression “$100”:

(i)

By omitting from section 20(2)(f) the words “forty dollars”, and substituting the expression “$100”.

4 Obstruction of Inspector

Section 18 of the principal Act is hereby amended by inserting, after the words “three months”, the words “or to a fine not exceeding $1,000, or to both”.

This Act is administered in the Ministry of Agriculture and Fisheries.
