An Act to amend the Scientific and Industrial Research

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title

This Act may be cited as the Scientific and Industrial Research Amendment Act 1979, and shall be read together with and deemed part of the Scientific and Industrial Research Act 1974 (hereinafter referred to as the principal Act).

2 Restrictions on use of name of Department in certain cases

(1)

The principal Act is hereby amended by inserting, after section 13, the following section:

“13A

“(1)

Except with the consent in writing of the Director-General, no person shall manufacture, sell, offer for sale, or distribute any goods under or using any name, title, or description which contains the name of the Department, the name of any of its divisions, or any abbreviation (including the word ‘DSIR’) by which the Department or division may be generally known.

“(2)

Except with the consent in writing of the Director-General, no person shall publish or cause or permit to be pub-lished any advertisement which relates to any goods and which—

“(a)

Refers to the goods by any name, title, or description which contains the name of the Department, the name of any of its divisions, or any abbrevia-tion (including the word ‘DSIR’) by which the Department or division may be generally known:

“(b)

Is calculated or likely to cause any other person to believe that the goods were developed, tested, or approved by or in the Department or by or in any research establishment administered by it.

“(3)

Every person commits an offence and is liable on summary conviction to a fine not exceeding $400 who contravenes the provisions of this section.”

(2)

Section 31(2)(e) of the Companies Act 1955 (as inserted by section 2(1) of the Companies Amendment Act 1965) is hereby amended by omitting the word ‘“Ruakura”’., and substituting the words ‘“Ruakura’; or”.

(3)

Section 31(2) of the Companies Act 1955 is hereby further amended by adding the following paragraph:

“(f)

Contains the word ‘DSIR’.”.

This Act is administered in the Department of Scientific and Industrial Research.
