An Act to amend the Westport Harbour Act 1920

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title

This Act may be cited as the Westport Harbour Amendment Act 1979, and shall be read together with and deemed part of the Westport Harbour Act 1920 (hereinafter referred to as the principal Act).

2 New sections substituted

(1)

The principal Act is hereby amended by repealing section 7, and substituting the following sections:

“7 Money to be appropriated by Parliament

“(1)

All money required for the purposes of this Act shall be paid out of the Consolidated Account out of money appropriated by Parliament for those purposes.

“(2)

All revenues derived from the Buller Coalfield Reserve and the Westport Colliery Reserve (being the lands respectively described in the Third and Fourth Schedules to the Westland and Nelson Coalfields Administration Act 1877) shall be paid into the Public Account to the credit of the Consolidated Account.

“7A Accounts to be prepared

The Minister of Finance shall continue to cause a balance sheet and profit and loss account to be prepared for each financial year in respect of the Westport Harbour undertaking, in accordance with the following provisions:

“(a)

The amount owing to the Consolidated Account in respect of the undertaking may be increased or decreased by such amount of the profit or loss of the undertaking during that year as the Minister of Finance directs to be capitalised:

“(b)

Interest at a rate from time to time fixed by the Minister of Finance shall be charged in the accounts on the amount for the time being owing as aforesaid.”

(2)

Sections 6 and 8 of the principal Act, and section 6 of the Westport Harbour Amendment Act 1926, are hereby amended by omitting the expression “Consolidated Fund” (as substituted by section 16 of the Finance Act 1932) wherever it occurs, and substituting in each case the expression “Consolidated Account”.

(3)

Section 16 of the Finance Act 1932 is hereby consequentially repealed.

This Act is administered in the Ministry of Transport.
