An Act to amend the Disabled Persons Community Welfare Act 1975
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Disabled Persons Community Welfare Amendment Act 1979, and shall be read together with and deemed part of the Disabled Persons Community Welfare Act 1975 (hereinafter referred to as the principal Act).
2 Grants and loans for purchase of motor vehicles, etc
(1)
The principal Act is hereby amended by inserting, after section 16, the following section:
“16A
“(1)
The Director-General may, in his discretion, grant to any disabled person financial assistance by way of a grant or a suspensory loan for or towards the provision of a motor vehicle or other mechanical means of transport, or the alteration of its mechanism, where such a vehicle or means of transport is necessary to enable a disabled person to undergo training for, or to obtain or to retain, employment which will enable the disabled person to achieve a substantial measure of financial independence.
“(2)
When considering any application for assistance under this section the Director-General shall have regard to—
“(a)
The availability of public transport to the disabled person and the extent to which he is able to use it:
“(b)
The distance between the disabled person’s ordinary place of residence and his place of work or training, and the time it would ordinarily take him to cover that distance without the use of a vehicle:
“(c)
The extent (if any) to which the vehicle is to be used by the disabled person in his work:
“(d)
The financial means of the disabled person and his or her spouse:
“(e)
Any assistance granted to the disabled person by the Accident Compensation Commission or by any other body or person.”
(2)
Section 26(3)(i) of the principal Act is hereby repealed.
This Act is administered in the Department of Social Welfare.
