An Act to amend the Fire Service Act 1975
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Fire Service Amendment Act 1979, and shall be read together with and deemed part of the Fire Service Act 1975 (hereinafter referred to as the principal Act).
2 Members of Commission
(1)
Section 6 of the principal Act is hereby amended by repealing subsection (1), and substituting the following subsection:
“(1)
The Commission shall consist of—
“(a)
Three members to be appointed from time to time by the Governor-General, on the recommendation of the Minister, namely:
“(i)
One member, being a person having a special knowledge of administration, who shall be appointed as Chairman of the Commission; and
“(ii)
Two members, being persons having a background of senior operational experience in a fire service, who shall be appointed as Fire Com-missioners.
“(b)
The Secretary for Internal Affairs.”
(2)
Section 6(3) of the principal Act is hereby amended by omitting the words “member of the Commission”
, and substituting the word “Commissioner”
.
(3)
Section 88(1) of the principal Act is hereby amended by omitting, from paragraph (a), the words “any Commissioner”
.
(4)
Section 2 of the principal Act is hereby consequentially amended—
(a)
By omitting from the definition of the expression “Commissioner”
the words “section 6(1)”
, and substituting the words “section 6(1)(a)”
:
(b)
By omitting from the definition of the expression “Fire Commissioner”
the words “section 6(1)(b)”
, and substituting the words “section 6(1)(a)(ii)”
.
3 Deputies of members
Section 9 of the principal Act is hereby amended by inserting, after subsection (1), the following subsection:
“(1A)
In the absence from any meeting of the Commission of the Secretary for Internal Affairs, he may authorise another officer of the Department of Internal Affairs to attend the meeting as his deputy, and any such deputy, while he acts as such, shall be deemed to be a member of the Commission.”
This Act is administered in the Department of Internal Affairs.
