An Act to amend the New Zealand Walkways Act 1975

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title

This Act may be cited as the New Zealand Walkways Amendment Act 1980, and shall be read together with and deemed part of the New Zealand Walkways Act 1975 (hereinafter referred to as the principal Act).

2 Term of office of appointed members of District Walkway Committees

Section 15 of the principal Act is hereby amended by repealing subsection (1), and substituting the following subsection:

“(1)

Except as otherwise provided in this Act, every appointed member of a District Walkway Committee shall hold office for a term of—

“(a)

Such period as may be specified by the Commission when making the appointment, where the appointment is made under section 14(2)(g) of this Act:

“(b)

Three years from the date of appointment, in any other case—

but may from time to time be reappointed.”

3 Finance

(1)

The principal Act is hereby further amended by repealing section 30, and substituting the following section:

“30

Except as otherwise provided in this Act, money required for—

“(a)

The establishment, administration, control, maintenance, and improvement of walkways by the Commission, each District Walkway Committee, and each controlling authority which is a department of State; and

“(b)

The discharge of any liability for damage to property incurred in respect of—

“(i)

A walkway; or

“(ii)

Any land available for public use as if it were a walkway, before it is gazetted as such, and which is the subject of an agreement made pursuant to section 22(1) of this Act—

shall be paid from the Consolidated Account out of money appropriated by Parliament for the purpose to the services of Vote Lands and Survey.”

(2)

Section 2(1) of the New Zealand Walkways Amendment Act 1978 is hereby consequentially repealed.

This Act is administered in the Department of Lands and Survey.
