An Act to amend the Crown Proceedings Act 1950
Be it enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title and commencement
(1)
This Act may be cited as the Crown Proceedings Amendment Act 1982, and shall be read together with and deemed part of the Crown Proceedings Act 1950 (hereinafter referred to as the principal Act).
(2)
This Act shall come into force on the 1st day of July 1983.
2 Discovery
(1)
Section 27(1)(a) of the principal Act is hereby amended by omitting the words “civil proceedings”
, and substituting the words “proceedings (other than criminal proceedings)”
.
(2)
Section 27 of the principal Act is hereby amended by repealing subsection (3), and substituting the following subsection:
“(3)
Without prejudice to the proviso to subsection (1) of this section, any rules made for the purposes of this section shall be such as to secure that the existence of a document will not be disclosed if—
“(a)
The Prime Minister certifies that the disclosure of the existence of that document would be likely to prejudice—
“(i)
The security or defence of New Zealand or the international relations of the Government of New Zealand; or
“(ii)
Any interest protected by section 7 of the Official Information Act 1982; or
“(b)
The Attorney-General certifies that the disclosure of the existence of that document would be likely to prejudice the prevention, investigation, or detection of offences.”
This Act is administered in the Department of Justice.
