An Act to amend the Hospitals Act 1957
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Hospitals Amendment Act 1982, and shall be read together with and deemed part of the Hospitals Act 1957 (hereinafter referred to as the principal Act).
2 Leases of land
(1)
Section 71 of the principal Act is hereby amended by inserting, after subsection (1), the following subsection:
“(1a)
The Public Bodies Leases Act 1969 shall not apply to any lease by a Board of land vested in it to any body or organisation conducted for the purposes of health or welfare and not for profit; and any such land may be leased for any term at any rent.”
(2)
Section 71(2) of the principal Act is hereby amended by omitting the words “All such”
, and substituting the words “Subject to subsection (1a) of this section, every lease by a Board of land vested in it”
.
3 Expenditure not otherwise authorised
(1)
The principal Act is hereby amended by repealing section 97a (as inserted by section 135(1) of the Public Finance Act 1977, and amended by section 2 of the Hospitals Amendment Act (No. 2) 1977), and substituting the following section:
“97a
“(1)
Subject to subsection (2) of this section, every Board, and every joint committee of an institution established under section 56 of this Act, may in any financial year, out of its maintenance account, expend for purposes not otherwise authorised by this Act or by any other Act or law for the time being in force, such sum or sums as it thinks fit.
“(2)
No Board or committee shall, in any financial year, expend under subsection (1) of this section any sum or sums exceeding, in the aggregate, the lesser of one-fifth of 1 percent of its maintenance payments for the previous year, and—
“(a)
In the case of the Auckland, Waikato, Palmerston North, Wellington, North Canterbury, and Otago Hospital Boards, $3,500:
“(b)
In every other case, $2,500.”
(2)
The following enactments are hereby consequentially repealed:
(a)
Section 135(1) of the Public Finance Act 1977:
(b)
The Hospitals Amendment Act (No. 2) 1977.
