An Act to amend the New Zealand Railways Corporation Act 1981

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title

This Act may be cited as the New Zealand Railways Corporation Amendment Act (No. 2) 1983, and shall be read together with and deemed part of the New Zealand Railways Corporation Act 1981 (hereinafter referred to as the principal Act).

2 Power to protect railway

Section 31 of the principal Act is hereby amended by inserting, after subsection (5), the following subsection:

“(5a)

Any person entering on any land on behalf of the Corporation pursuant to this section shall carry identification and produce it on initial entry and, if requested, at any subsequent time.”

3 Lights, etc., liable to be confused with railway signals

Section 52 of the principal Act is hereby amended by adding the following subsection:

“(5)

Any person entering on any land on behalf of the Corporation pursuant to subsection (4) of this section shall carry identification and produce it on initial entry and, if requested, at any subsequent time.”

4 Appointment of officers under contract

(1)

The principal Act is hereby amended by inserting, after section 75, the following section:

“75a

Notwithstanding anything in this Act, the Corporation may, in such circumstances as it may determine, appoint persons to not more than 4 positions of officers of the Corporation under individual contracts for such terms of appointment, and on such terms and conditions of service, as the Corporation may determine:

“Provided that the salaries to be paid under all such contracts shall be determined by the Higher Salaries Commission in the same manner as the salaries of those persons to whom section 12(1)(a)(v) of the Higher Salaries Commission Act 1977 applies.”

Section 67 of the principal Act is hereby consequentially amended by adding the following subsection:

“(3)

This section shall not apply to any person appointed as an officer under section 75a of this Act.”

Section 68 of the principal Act is hereby consequentially amended by adding the following subsection:

“(3)

This section shall not apply to any person appointed as an officer under section 75a of this Act.”

(4)

Section 76 of the principal Act is hereby consequentially amended by adding the following subsections:

“(3)

This section shall not apply in relation to the appointment of any person as an officer under section 75a of this Act.

“(4)

For the purposes of subsection (1) of this section, the expression ‘member in the service of the Corporation’ does not include a person appointed as an officer under section 75a of this Act.”

5 Offences

Section 115(1)(m) of the principal Act is hereby amended by omitting the word “Department”, and substituting the word “Corporation”.

6 First Schedule

(1)

The First Schedule to the principal Act is hereby amended by omitting from clause 10 the item “Goods Manager”, and substituting the following items:

“Freight Terminal Manager;

Chief Data Processing Officer.”

(2)

The First Schedule to the principal Act is hereby further amended by omitting from clause 13 the item “Electrical Superintendent”.

This Act is administered in the New Zealand Railways Corporation.
