An Act to amend the Public Trust Office Act 1957

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title and commencement

(1)

This Act may be cited as the Public Trust Office Amendment Act 1983, and shall be read together with and deemed part of the Public Trust Office Act 1957 (hereinafter referred to as the principal Act).

(2)

Section 3 of this Act shall come into force on the 1st day of April 1984.

(3)

Except as provided in subsection (2) of this section, this Act shall come into force on the date on which it receives the Governor-General’s assent.

2 Power of Public Trustee to elect to administer small estates without grant of administration

(1)

Section 72 of the principal Act (as amended by section 3 of the Public Trust Office Amendment Act 1978) is hereby amended—

(a)

By omitting from subsection (1) the expression “$15,000”, and substituting the expression “$40,000”:

(b)

By omitting from subsection (6) the expression “$20,000”, and substituting the expression “$60,000”.

(2)

Section 73 of the principal Act (as amended by section 4 of the Public Trust Office Amendment Act 1978) is hereby amended—

(a)

By omitting from subsection (1) the expression “$15,000”, and substituting the expression “$40,000”:

(b)

By omitting from subsection (3) the expression “$20,000”, and substituting the expression “$60,000”.

(3)

Sections 3 and 4 of the Public Trust Office Amendment Act 1978 are hereby repealed.

3 Court fees payable on elections, etc

Section 77(2) of the principal Act (as amended by section 7 of the Decimal Currency Act 1964) is hereby amended by omitting the words “50 cents or such other fee as may be prescribed”, and substituting the words “such amount as may from time to time be prescribed by regulations made under this Act”.

This Act is administered in the Public Trust Office.
