An Act to amend the Dog Control and Hydatids Act 1982

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title

This Act may be cited as the Dog Control and Hydatids Amendment Act 1983, and shall be read together with and deemed part of the Dog Control and Hydatids Act 1982 (hereinafter referred to as the principal Act).

2 Exemption of dogs from treatment

(1)

Section 73 of the principal Act is hereby amended by inserting, after subsection (1), the following subsection:

“(1a)

Without limiting subsection (1) of this section, the Council may from time to time make declarations that provide for the exemption of dogs from examination and treatment for hydatids by dog control officers or field advisory officers where the officer is satisfied that conditions relating to the control and feeding of the dog, the districts where it is usually kept or may be taken, the occupation of the owner, the purposes for which the dog is likely to be used, and such other conditions relating to the owner or the dog as the Council shall specify in the declaration are likely to be observed; and may provide for the review and revocation of such exemptions in particular cases by the Council or by dog control officers or field advisory officers where the Council or officer is satisfied—

“(a)

That the exemption should not have been granted; or

“(b)

That the conditions of the exemption have not been or are not being observed.”

(2)

Section 73(2) of the principal Act is hereby amended by inserting, after the expression “subsection (1)”, the expression “or subsection (1a)”.

(3)

Section 73 of the principal Act is hereby further amended by inserting, after subsection (3), the following subsection:

“(3a)

Notice of any declaration under subsection (1a) of this section and any amendment or revocation of the declaration under subsection (2) of this section shall be given by the Council to every territorial authority.”

3 Regulations

(1)

Section 80 of the principal Act is hereby amended by inserting, after paragraph (a), the following paragraph:

“(aa)

Prohibiting or restricting the movement of dogs or classes of dogs between districts subject to such conditions as are specified in the regulations:”.

(2)

Section 80(d) of the principal Act is hereby amended by inserting, after the word “hydatids” where it first occurs, the words “or are exempted from such treatment”.

This Act is administered in the Ministry of Agriculture and Fisheries.
