An Act to amend the Hospitals Act 1957
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Hospitals Amendment Act 1983, and shall be read together with and deemed part of the Hospitals Act 1957 (hereinafter referred to as the principal Act).
2 Payment without probate
(1)
The principal Act is hereby amended by repealing section 150, and substituting the following section:
“150
Where there is in the possession of a Board a sum of money not exceeding $2,000 payable to any person who died while an inmate or patient of any institution under that Board’s control, that Board may deduct from that sum—
“(a)
Any amounts lawfully recoverable by it in respect of the cost of any relief provided by it for that person:
“(b)
The amount of any funeral expenses paid by it in respect of that person;—
and may pay any balance then remaining in accordance with section 65 of the Administration Act 1969 as if it were a bank within the meaning of that section.”
(2)
The following provisions are hereby consequentially repealed:
(a)
Section 4(4) of the Administration Amendment Act 1964:
(b)
So much of the First Schedule to the Hospitals Amendment Act 1970 as relates to section 150 of the principal Act.
3 Change of name of hospital board
The First Schedule to the principal Act is hereby amended by omitting, from the first column of item 10, the word “North”
.
This Act is administered in the Department of Health.
