An Act to amend the Ministry of Transport Act 1968
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Ministry of Transport Amendment Act 1983, and shall be read together with and deemed part of the Ministry of Transport Act 1968 (hereinafter referred to as the principal Act).
2 Deputy Secretaries for Transport
The principal Act is hereby amended by repealing section 6, and substituting the following section:
“6
“(1)
There shall from time to time be appointed under the State Services Act 1962 one or more Deputy Secretaries for Transport who, subject to the control of the Secretary, shall have and may exercise all of the powers, duties, and functions of the Secretary.
“(2)
On the occurrence from any cause of a vacancy in the office of Secretary, and so long as the vacancy continues, one of the Deputy Secretaries designated for the purpose by the State Services Commission shall be the administrative head of the Ministry.
3 Staff to act under direction of Secretary
(1)
Section 7 of the principal Act is hereby amended by repealing subsection (2), and substituting the following subsection:
“(2)
Except as provided in section 18(3) of the Civil Aviation Act 1964 in the case of the Chief Inspector of Air Accidents in the exercise of his special duties and functions under Part III of that Act, all officers and employees of the Ministry shall act under the direction of the Secretary in the exercise and performance of the powers, duties, and functions conferred or imposed on them by this Act or any other enactment or by the Minister, and shall have all such powers, duties, and functions as may be conferred upon them by any enactment or by the Minister, or may be delegated or assigned to them by the Secretary.”
(2)
Sections 16(2) and 20(3) of the Civil Aviation Act 1964 are hereby repealed.
This Act is administered in the Ministry of Transport.
