An Act to amend the Testing Laboratory Registration Act 1972

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title

This Act may be cited as the Testing Laboratory Registration Amendment Act 1983, and shall be read together with and deemed part of the Testing Laboratory Registration Act 1972 (hereinafter referred to as the principal Act).

2 Functions of Council

The principal Act is hereby amended by repealing section 12, and substituting the following section:

“12

The general functions of the Council shall be—

“(a)

To promote the development and maintenance of good laboratory practice in testing and to establish and maintain a scheme for the registration of testing laboratories in respect of which application is made for registration and which comply with that practice; and

“(b)

To promote the development and maintenance of good quality assurance practice in the supply of goods and services and to establish and maintain a scheme for the registration of suppliers in respect of whom application is made for registration and who comply with that practice.”

3 Powers of Council

(1)

Section 13(2) of the principal Act is hereby amended by inserting, after paragraph (d), the following paragraphs:

“(da)

Provide for the registration of persons or bodies which undertake any or all of the design, manufacture, supply, installation, and testing of goods and services in respect of all activities and functions concerned with the attainment of quality and which, in the opinion of the Council, comply with the requirements prescribed by the Council, subject to such conditions as it thinks fit:

“(db)

Provide for the revocation of the registration of any person or body pursuant to paragraph (da) of this subsection, after consideration of any submissions made on behalf of that person or body, for failing to comply with all or any of the requirements or conditions prescribed by the Council on the registration of that person or body:

“(dc)

Require, in respect of any person or body registered pursuant to paragraph (da) of this subsection, the institution and maintenance, to the satisfaction of the Council, of control of the activities and functions concerned with the attainment of quality, and the maintenance of such records as, in the opinion of the Council, are necessary to establish that such control is maintained:”.

(2)

Section 13(2) of the principal Act is hereby further amended by omitting from paragraph (m) the words “of testing laboratories”, and substituting the words “under this Act”.

This Act is administered in the Department of Scientific and Industrial Research.
