An Act to amend the Toxic Substances Act 1979
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Toxic Substances Amendment Act 1983, and shall be read together with and deemed part of the Toxic Substances Act 1979 (hereinafter referred to as the principal Act).
2 Containers
(1)
Section 26(1)(c) of the principal Act is hereby repealed.
(2)
Section 26 of the principal Act is hereby further amended by inserting, after subsection (1), the following subsection:
“(1a)
Notwithstanding subsection (1) of this section, no person shall, in the course of any business, pack any deadly poison otherwise than in a container of a design or type that has been approved by the Director.”
3 Regulations
Section 82(1) of the principal Act is hereby amended by inserting, after paragraph (d), the following paragraph:
“(da)
Regulating the construction of, and the fittings and appliances to be carried on, vehicles carrying toxic substances, and providing for the approval of tank vehicles for the carriage of toxic substances:”.
This Act is administered in the Department of Health.
