Contents
An Act to amend the Administration Act 1969
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title and commencement
(1)
This Act may be cited as the Administration Amendment Act 1985, and shall be read together with and deemed part of the Administration Act 1969 (hereinafter referred to as the principal Act).
(2)
This Act shall be deemed to have come into force on the date of commencement of the Administration Amendment Act 1982.
2 Other Acts, etc., not affected
Section 67(2) of the principal Act is hereby amended by inserting, after the words “Nothing in this Act”
, the words “, other than Part Ia,”
.
3 Application of Part
(1)
Section 68b(1) of the principal Act (as inserted by section 2 of the Administration Amendment Act 1982) is hereby amended by omitting the expression “subsection (2)”
, and substituting the expression “subsections (2) and (2a)”
.
(2)
Section 68b of the principal Act (as so inserted) is hereby amended by inserting, after subsection (2), the following subsection:
“(2a)
The revocation, before the date of commencement of this Part of this Act, of a testamentary disposition shall not affect a nomination made before the date of that revocation; but if a testamentary disposition revoked before the date of commencement of this Part of this Act is revived or republished on or after that date of commencement, this Part of this Act shall apply in respect of any revocation of a testamentary disposition contained in the revived or republished testamentary disposition.”
4 Effect of nominations
Section 68c of the principal Act (as inserted by section 2 of the Administration Amendment Act 1982) is hereby amended by adding the following subsection:
“(4)
Notwithstanding section 24 of this Act, it shall not be necessary to pay to the administrator of a deceased nominator any money in an account that is subject to a nomination by reason only that it forms part of the deceased nominator’s estate pursuant to subsection (3) of this section.”
