An Act to amend the Legislature Act 1908
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Legislature Amendment Act 1985, and shall be read together with and deemed part of the Legislature Act 1908 (hereinafter referred to as the principal Act).
2 Interpretation: Exemption of members and officers from attendance as witnesses
(1)
Section 257(1) of the principal Act is hereby amended by repealing the definition of the term “Court of record”
(as amended by section 3 of the District Courts Abolition Act 1925 and section 14(4) of the Admiralty Act 1973), and substituting the following definition:
“‘Court of record’ means the Court of Appeal, the High Court, and every District Court:”.
(2)
Section 14(4) of the Admiralty Act 1973 is hereby consequentially repealed.
3 Repeal of obsolete provisions relating to exemption of officers and members bound by recognisance
(1)
The principal Act is hereby amended by repealing sections 258 and 262.
(2)
The principal Act is hereby consequentially amended in the manner indicated in the Schedule to this Act.
4 Service of process of Courts not of record
Section 267 of the principal Act is hereby amended by omitting the words “which, prior to the coming into operation of the Criminal Code Act 1893, would have been classed as a felony or misdemeanour”
.
