An Act to amend the Ministry of Energy Act 1977

BE IT ENACTED by the Parliament of New Zealand as follows:

1 Short Title and commencement

(1)

This Act may be cited as the Ministry of Energy Amendment Act (No. 2) 1987, and shall be read together with and deemed part of the Ministry of Energy Act 1977 (hereinafter referred to as the principal Act).

(2)

This Act shall come into force on the 1st day of January 1988.

2 Functions of Ministry

Section 11(4) of the principal Act is hereby amended by repealing paragraph (c), and substituting the following paragraphs:

“(c)

Undertake the establishment, maintenance, development, and co-ordination of adequate sources of supply of energy (other than electricity) for New Zealand;

“(ca)

Promote and encourage the establishment, maintenance, development, and co-ordination of adequate sources of supply of energy for New Zealand;”.

3 Functions of Ministry under other enactments

Section 14 of the principal Act is hereby amended by adding, as subsection (2), the following subsection:

“(2)

Nothing in section 15 of this Act shall affect the powers of the Crown under the Southland Electric Power Supply Act 1936.”

4 Non-commercial activities

The principal Act is hereby amended by inserting, after section 14, the following section:

“14a

Notwithstanding anything in section 15 of this Act, the Crown may from time to time enter into agreements pursuant to section 7 of the State-Owned Enterprises Act 1986 providing for the generation or distribution of electricity.”

5 Participation in operations

Section 15 of the principal Act is hereby amended by adding the following subsection:

“(15)

In this section the term ‘energy’ includes electricity generated—

“(a)

By the use of geothermal energy; or

“(b)

For the purpose of supplying electricity to the Chatham Islands,—

but does not include electricity generated by any other means or for any other purpose.”

6 Financial provisions

(1)

Section 15b(a) and (b) of the principal Act (as inserted by section 144(2) of the Public Finance Act 1977) is hereby repealed.

(2)

Section 15e(a) of the principal Act (as so inserted) is hereby amended by omitting the words “the national electrical system or”.

(3)

Section 15e(d) of the principal Act (as so inserted) is hereby repealed.

7 Acts administered by Ministry of Energy

The First Schedule to the principal Act is hereby amended by omitting the item relating to the Lake Coleridge Water-power Act 1915.

This Act is administered in the Ministry of Energy.
