An Act to amend the Alcoholic Liquor Advisory Council Act 1976

BE IT ENACTED by the Parliament of New Zealand as follows:

1 Short Title

This Act may be cited as the Alcoholic Liquor Advisory Council Amendment Act 1987, and shall be read together with and deemed part of the Alcoholic Liquor Advisory Council Act 1976 (hereinafter referred to as the principal Act).

2 Transfer of responsibility from Minister of Justice to Minister of Health

(1)

Section 2(1) of the principal Act is hereby amended by repealing the definition of the term “Minister”, and substituting the following definition:

“‘Minister’ means the Minister of Health:”.

(2)

Section 8(1) of the principal Act is hereby amended by repealing paragraph (g), and substituting the following paragraphs:

“(g)

To consider and report upon to the Minister of Justice such matters relating to the law governing the sale and consumption of liquor as may be referred to the Council from time to time by that Minister:

“(ga)

To consider and report upon to the Minister such matters relating to the use or misuse of liquor as may be referred to the Council from time to time by the Minister:”.

Section 14(2) of the principal Act is hereby amended by omitting the words “of Justice”.

(4)

Section 34(4) of the principal Act (as added by section 13(2) of the Alcoholic Liquor Advisory Council Amendment Act 1978) is hereby amended by omitting the words “Department of Justice”, and substituting the words “Director-General of Health”.

3 Alcoholic Liquor Account

Section 21(2) of the principal Act is hereby amended by adding the words “or by 1 member and the chief executive officer”.

This Act is administered in the Department of Justice.
