An Act to amend the Civil List Act 1979

BE IT ENACTED by the Parliament of New Zealand as follows:

1 Short Title

This Act may be cited as the Civil List Amendment Act 1987, and shall be read together with and deemed part of the Civil List Act 1979 (hereinafter referred to as the principal Act).

2 Allowances payable to members of Parliament

(1)

Where, at any time in the period beginning on the 1st day of April 1973 and ending with the passing of this Act, an allowance has been paid to a member of Parliament out of money appropriated by Parliament—

(a)

For acting as a committee of one of a party caucus; or

(b)

For attending a meeting of a committee of a party caucus (being a committee with a quorum of 2),—

the payment of that allowance is hereby validated and is hereby declared to be and to have always been lawful.

(2)

Where, at any time after the passing of this Act, a member of Parliament—

(a)

Either—

(i)

Acts as a committee of one of a party caucus; or

(ii)

Attends a meeting of a committee of a party caucus (being a committee with a quorum of 2); and

(b)

Would, if attending a properly notified meeting of a committee of a party caucus (being a committee with a quorum of not less than 3), be entitled to be paid, under the Parliamentary Salaries and Allowances Determination 1987 (S.R. 1987/117), a day allowance or a night allowance,—

there shall be paid to that member under the principal Act an allowance of the same amount as that of that day allowance or night allowance, as the case may require.

(3)

Nothing in this section limits the power of the Higher Salaries Commission to amend or revoke the Parliamentary Salaries and Allowances Determination 1987 (S.R. 1987/117).
