An Act to amend the Alcoholism and Drug Addiction Act 1966
BE IT ENACTED by the Parliament of New Zealand as follows:
1 Short Title and commencement
(1)
This Act may be cited as the Alcoholism and Drug Addiction Amendment Act 1987, and shall be read together with and deemed part of the Alcoholism and Drug Addiction Act 1966 (hereinafter referred to as the principal Act).
(2)
This Act shall come into force on the 28th day after the date on which it receives the Governor-General’s assent.
2 Persons found intoxicated in public place
Section 37a of the principal Act (as inserted by section 49 of the Summary Offences Act 1981) is hereby amended by inserting, after subsection (2), the following subsection:
“(2a)
Notwithstanding anything in subsection (2) of this section, where it is not immediately practicable for the constable to determine where to take the person in accordance with that subsection, the constable may take the person to a police station and detain that person there for such time as may be reasonably required to enable enquiries to be made as to the appropriate course to be followed.”
This Act is administered in the Department of Health.
