An Act to amend the Agricultural Workers Act 1977
BE IT ENACTED by the Parliament of New Zealand as follows:
1 Short Title and commencement
(1)
This Act may be cited as the Agricultural Workers Amendment Act 1987, and shall be read together with and deemed part of the Agricultural Workers Act 1977 (hereinafter referred to as the principal Act).
(2)
This Act shall come into force on the 1st day of August 1987.
2 Interpretation
(1)
The principal Act is hereby amended by repealing section 2, and substituting the following section:
“2
In this Act, unless the context otherwise requires,—
“‘Agricultural worker’ or ‘worker’—
“(a)
Means a person employed for hire or reward in the keeping and care of animals on any farm or station or in agricultural, horticultural, pastoral, silvicultural, flaxmilling, bush working, or saw milling work of any kind; and
“(b)
Includes a person employed for hire or reward on a farm or station to cook meals for persons of the kind described in paragraph (a) of this definition (other than a person employed solely to cook meals for shearers within the meaning of the Shearers Act 1962); but
“(c)
Does not include—
“(i)
Any shearer within the meaning of the Shearers Act 1962; or
“(ii)
Any person being trained at any institution established for the training of persons of the kind described in paragraph (a) of this definition; or
“(iii)
Any apprentice bound by a contract of apprenticeship under the Apprenticeship Act 1983:
“‘Employer’ includes every person having the control or superintendence of any farm or other place where any agricultural worker is employed other than an employer within the meaning of the Sharemilking Agreements Act 1937; and also includes every sharemilker within the meaning of that Act:
“‘Inspector’ means an Inspector appointed under section 5 of this Act; and includes an Inspector within the meaning of the Factories and Commercial Premises Act 1981:
“‘Minister’ means the Minister of Labour:
“‘Noise’ includes sound energy of any frequency, whether or not capable of being perceived by the unaided human ear.”
(2)
Section 2(2) of the Agricultural Workers Amendment Act 1981 is hereby consequentially repealed.
3 Powers of Inspectors
Section 6(1)(f) of the principal Act is hereby amended by omitting the words “, regulations made hereunder, and any award,”
, and substituting the words “and regulations made under this Act”
.
4 Offences generally
Section 59 of the principal Act is hereby amended by omitting the words “(other than Part IV)”
in both places where they occur.
5 Provisions as to procedure
Section 60 of the principal Act (as amended by section 5 of the Agricultural Workers Amendment Act 1977) is hereby amended by omitting the words “(other than offences punishable on conviction by the Arbitration Court)”

6 Repeals
The following enactments are hereby repealed, namely:
(a)
Section 9 of the principal Act:

Parts II, III, and IV of, and the First Schedule to, the principal Act:
(c)
Sections 2, 3, and 5, and the Schedule to, the Agricultural Workers Amendment Act 1977:
(d)
The Agricultural Workers Amendment Act 1979:
(e)
The Agricultural Workers Amendment Act 1980:
(f)
The Agricultural Workers Amendment Act 1982:
(g)
The Agricultural Workers Amendment Act 1984:
(h)
The Agricultural Workers Amendment Act 1985.
7 Revocations
The Industrial Relations Amendment Act Commencement Order 1978 (S.R. 1978/99) and the Agricultural Workers (Workers’ Organisation Membership) Regulations 1985 (S.R. 1985/155) are hereby revoked.
This Act is administered in the Department of Labour.
