Contents
An Act to amend the Evidence Act 1908
BE IT ENACTED by the Parliament of New Zealand as follows:
1 Short Title and commencement
(1)
This Act may be cited as the Evidence Amendment Act 1988, and shall be read together with and deemed part of the Evidence Act 1908 (hereinafter referred to as the principal Act).
(2)
This Act shall come into force on the 1st day of January 1989.
2 New section inserted
The principal Act is hereby amended by inserting, immediately before the heading “Impeaching Credit of Witnesses”, the following section:
“8a Questions tending to establish a debt or civil liability
A witness shall not be excused from answering any question relevant to the proceedings on the sole ground that to answer the question may establish or tend to establish that the witness owes a debt, or otherwise subject the witness to any civil liability.”

3 Copy of public Act, Imperial legislation, and regulations printed as prescribed to be evidence
The principal Act is hereby amended by repealing section 29, and substituting the following section:
“29
“(1)
Every copy of any public Act, or of any Imperial enactment or any Imperial subordinate legislation (as defined in section 2 of the Imperial Laws Application Act 1988), being a copy printed (whether before or after the commencement of this section) under the authority of the Government by the Government Printer, shall be evidence of that Act or Imperial enactment or Imperial subordinate legislation, and of its contents; and any copy of any such Act or Imperial enactment or Imperial subordinate legislation purporting to be so printed shall be deemed to be so printed unless the contrary is proved.
“(2)
Every copy of any Imperial enactment or Imperial subordinate legislation, being a copy purporting to be printed (whether before or after the commencement of this section) by the Queen’s or King’s Printer or under the superintendence or authority of Her Majesty’s Stationery Office in the United Kingdom, shall, unless the contrary is proved,—
“(a)
Be evidence of that Imperial enactment or Imperial subordinate legislation, and of its contents; and
“(b)
Be deemed to be so printed.
“(3)
Every copy of any regulations (as defined in section 28(3) of this Act) that are made (whether before or after the commencement of this section) pursuant to any public Act and are printed by the Government Printer pursuant to the Regulations Act 1936 shall be evidence of those regulations, and of their contents; and every copy of any such regulations purporting to be so printed shall be deemed to be so printed unless the contrary is proved.”
4 Proclamations, Orders in Council, etc.
Section 32 of the principal Act is hereby amended by omitting the words “Subject to subsection (2) of section 29 of this Act”
(as inserted by section 3(2) of the Evidence Amendment Act 1972), and substituting the words “Subject to section 29(3) of this Act”
.
5 Regulations Act 1936 consequentially amended
The Regulations Act 1936 is hereby amended—
(a)
By omitting from section 5 the words “Subject to subsection (2) of section 29 of the Evidence Act 1908(as added by subsection (1) of section 3 of the Evidence Amendment Act 1972)”
(as inserted by section 3(3)(a) of the Evidence Amendment Act 1972), and substituting the words “Subject to section 29(3) of the Evidence Act 1908,”
:
(b)
By omitting from subsection (4) of section 7 the words “Subject to subsection (2) of section 29 of the Evidence Act 1908 (as added by subsection (1) of section 3 of the Evidence Amendment Act 1972)”
(as inserted by section 3(3)(b) of the Evidence Amendment Act 1972), and substituting the words “Subject to section 29(3) of the Evidence Act 1908,”
.
6 Consequential repeal
Section 3 of the Evidence Amendment Act 1972 is hereby consequentially repealed.
