Contents
An Act to issue and apply certain sums of money out of the Public Account and other accounts to the service of the year ending with the 31st day of March 1989, and to appropriate the supply granted in this year, and to vary the appropriations made by the Appropriation Act 1988
MOST GRACIOUS SOVEREIGN,—We, Your Majesty’s most dutiful and loyal subjects, the House of Representatives of New Zealand in Parliament assembled, towards making good the supply which we have cheerfully granted to Your Majesty in this year, have resolved to grant unto Your Majesty (subject to certain variations in the sums granted by the Appropriation Act 1988) the sums hereinafter mentioned, and do therefore most humbly beseech Your Majesty that it may be enacted: And be it enacted by the Parliament of New Zealand as follows:
1 Short Title
(1)
This Act may be cited as the Appropriation Act (No. 2) 1988.
(2)
This Act relates to the year ending with the 31st day of March 1989 (hereinafter referred to as this year).
2 Grants and appropriations
The grants and appropriations authorised by sections 3 and 5 of this Act to be issued and applied are additional to those authorised for this year by the Appropriation Act 1988.
3 Grant and appropriation of $360,878,000 out of Consolidated Account
(1)
The Minister of Finance may issue and apply out of the Consolidated Account, towards making good the supply granted to Her Majesty for the service of this year, any sums which do not exceed the sum of $360,878,000.
(2)
The sums to which subsection (1) of this section relates are hereby appropriated for the services and purposes expressed in the several votes specified in the First Schedule to this Act to the extent set out in Column 1 of that Schedule.
4 Reduction of $7,011,332,000 in previous appropriations out of Loans Account
(1)
The maximum sum that the Minister of Finance is authorised by section 3 of the Appropriation Act 1988 to issue and apply out of the Loans Account specified in the Second Schedule to that Act, towards making good the supply granted to Her Majesty for the service of this year, is hereby reduced by $7,011,332,000.
(2)
The sums appropriated by section 3 of the Appropriation Act 1988 for the services and purposes expressed in the several votes specified in the Second Schedule to that Act are hereby reduced by $7,011,332,000 as set out in Column 1 of the Second Schedule to this Act.
5 Grant and appropriation of $55,000 out of Earthquake and War Damage Fund
(1)
The Minister of Finance may issue and apply out of the Earthquake and War Damage Fund towards making good the supply granted to Her Majesty for the service of this year, any sums which do not exceed the sum of $55,000.
(2)
The sums to which subsection (1) of this section relates are hereby appropriated for the services and purposes expressed in the Vote Earthquake and War Damage (as set out in the Third Schedule to this Act) to the extent set out in Column 1 of that Schedule.
6 Transitional provision in respect of Ministry of Commerce
Notwithstanding anything in section 3 of this Act or in section 2 of the Appropriation Act 1988 or in section 53 of the Public Finance Act 1977,—
(a)
Any part of the sum of $73,992,000 appropriated by section 2(2) of the Appropriation Act 1988 for the services and purposes of the Vote Customs less the reduction of $146,000 in the Vote Customs as set out in the First Schedule to this Act may, pursuant to section 3(1) of this Act or section 2(1) of the Appropriation Act 1988, be issued and applied out of the Consolidated Account not only for the services and purposes of the Customs Department but also for the services and purposes of the Ministry of Commerce—
(i)
As if the Vote Customs were the Vote Commerce; and
(ii)
As if the services and purposes set out in the estimates for this year (B. 7 [Pt. I]) and the supplementary estimates for this year (B. 7 [Pt. II]) as the services and purposes of the Customs Department were services and purposes of the Ministry of Commerce; and
(b)
Any part of the sum of $44,835,000 appropriated by section 3(2) of this Act and any part of the sum of $528,760,000 appropriated by section 2(2) of the Appropriation Act 1988 for the services and purposes of the Vote Justice may, pursuant to section 3(1) of this Act or section 2(1) of the Appropriation Act 1988, be issued and applied out of the Consolidated Account not only for the services and purposes of the Department of Justice but also for the services and purposes of the Ministry of Commerce—
(i)
As if the Vote Justice were the Vote Commerce; and
(ii)
As if the services and purposes set out in the estimates for this year (B. 7 [Pt. I]) and the supplementary estimates for this year (B. 7 [Pt. II]) as the services and purposes of the Department of Justice were services and purposes of the Ministry of Commerce; and
(c)
Any part of the sum of $519,339,000 appropriated by section 2(2) of the Appropriation Act 1988 for the services and purposes of the Vote Labour less the reduction of $2,780,000 in the Vote Labour as set out in the First Schedule to this Act may, pursuant to section 3(1) of this Act or section 2(1) of the Appropriation Act 1988, be issued and applied out of the Consolidated Account not only for the services and purposes of the Department of Labour but also for the services and purposes of the Ministry of Commerce—
(i)
As if the Vote Labour were the Vote Commerce; and
(ii)
As if the services and purposes set out in the estimates for this year (B. 7 [Pt. I]) and the supplementary estimates for this year (B. 7 [Pt. II]) as the services and purposes of the Department of Labour were services and purposes of the Ministry of Commerce; and
(d)
Any part of the sum of $133,241,000 appropriated by section 2(2) of the Appropriation Act 1988 for the services and purposes of the Vote Trade and Industry less the reduction of $46,391,000 in the Vote Trade and Industry as set out in the First Schedule to this Act may, pursuant to section 3(1) of this Act or section 2(1) of the Appropriation Act 1988, be issued and applied out of the Consolidated Account not only for the services and purposes of the Department of Trade and Industry but also for the services and purposes of the Ministry of Commerce—
(i)
As if the Vote Trade and Industry were the Vote Commerce; and
(ii)
As if the services and purposes set out in the estimates for this year (B. 7 [Pt. I]) and the supplementary estimates for this year (B. 7 [Pt. II]) as the services and purposes of the Department of Trade and Industry were services and purposes of the Ministry of Commerce.
7 Transitional provision in respect of Ministry of External Relations and Trade
Notwithstanding anything in section 3 of this Act or in section 2 of the Appropriation Act 1988 or in section 53 of the Public Finance Act 1977,—
(a)
Any part of the sum of $289,900,000 appropriated by section 2(2) of the Appropriation Act 1988 for the services and purposes of the Vote Foreign Affairs less the reduction of $127,065,000 in the Vote Foreign Affairs as set out in the First Schedule to this Act may, pursuant to section 3(1) of this Act or section 2(1) of the Appropriation Act 1988, be issued and applied out or the Consolidated Account not only for the services and purposes of the Ministry of Foreign Affairs but also for the services and purposes of the Ministry of External Relations and Trade—
(i)
As if the Vote Foreign Affairs were the Vote External Relations and Trade; and
(ii)
As if the services and purposes set out in the estimates for this year (B. 7 [Pt. I]) and the supplementary estimates for this year (B. 7 [Pt. II]) as the services and purposes of the Ministry of Foreign Affairs were services and purposes of the Ministry of External Relations and Trade; and
(b)
Any part of the sum of $133,241,000 appropriated by section 2(2) of the Appropriation Act 1988 for the services and purposes of the Vote Trade and Industry less the reduction of $46,391,000 in the Vote Trade and Industry as set out in the First Schedule to this Act may, pursuant to section 3(1) of this Act or section 2(1) of the Appropriation Act 1988, be issued and applied out of the Consolidated Account not only for the services and purposes of the Department of Trade and Industry but also for the services and purposes of the Ministry of External Relations and Trade—
(i)
As if the Vote Trade and Industry were the Vote External Relations and Trade; and
(ii)
As if the services and purposes set out in the estimates for this year (B. 7 [Pt. I]) and the supplementary estimates for this year (B. 7 [Pt. II]) as the services and purposes of the Department of Trade and Industry were services and purposes of the Ministry of External Relations and Trade.
8 Transitional provision in respect of Government Superannuation Fund Department
Notwithstanding anything in section 3 of this Act or in section 2 of the Appropriation Act 1988 or in section 53 of the Public Finance Act 1977, any part of the sum of $119,210,000 appropriated by section 2(2) of the Appropriation Act 1988 for the services and purposes of the Vote Treasury less the reduction of $715,000 in the Vote Treasury as set out in the First Schedule to this Act may, pursuant to section 3(1) of this Act or section 2(1) of the Appropriation Act 1988, be issued and applied out of the Consolidated Account not only for the services and purposes of the Treasury but also for the services and purposes of the Government Superannuation Fund Department—
(a)
As if the Vote Treasury were the Vote Government Superannuation Fund Department; and
(b)
As if the services and purposes set out in the estimates for this year (B. 7 [Pt. I]) and the supplementary estimates for this year (B. 7 [Pt. II]) as the services and purposes of the Treasury were services and purposes of the Government Superannuation Fund Department.
9 Transitional provision in respect of Ministry of Maori Affairs
Notwithstanding anything in section 3 of this Act or in section 2 of the Appropriation Act 1988 or in section 53 of the Public Finance Act 1977, any part of the sum of $265,380,000 appropriated by section 2(2) of the Appropriation Act 1988 for the services and purposes of the Vote Maori Affairs less the reduction of $1,393,000 in the Vote Maori Affairs as set out in the First Schedule to this Act may, pursuant to section 3(1) of this Act or section 2(1) of the Appropriation Act 1988, be issued and applied out of the Consolidated Account not only for the services and purposes of the Department of Maori Affairs but also for the services and purposes of the Ministry of Maori Affairs—
(a)
As if the Vote Maori Affairs were the Vote Ministry of Maori Affairs; and
(b)
As if the services and purposes set out in the estimates for this year (B. 7 [Pt. I]) and the supplementary estimates for this year (B. 7 [Pt. II]) as the services and purposes of the Department of Maori Affairs were services and purposes of the Ministry of Maori Affairs.
