An Act to amend the New Zealand Walkways Act 1975
BE IT ENACTED by the Parliament of New Zealand as follows:
1 Short Title
This Act may be cited as the New Zealand Walkways Amendment Act 1988, and shall be read together with and deemed part of the New Zealand Walkways Act 1975 (hereinafter referred to as the principal Act).
2 New Zealand Walkway Commission
(1)
Section 4(2) of the principal Act is hereby amended by repealing paragraphs (c) and (d), and substituting the following paragraph:
“(c)
Two persons appointed by the Minister, on the nomination of the New Zealand Local Government Association Incorporated:”.
(2)
Notwithstanding anything in subsection (1) of this section, where, immediately before the commencement of this section, any person (being a person who was appointed to be a member of the Commission pursuant to paragraph (c) or paragraph (d) of section 4(2) of the principal Act) was continuing in office pursuant to section 5(2) of the principal Act, that person shall, unless that person sooner dies or vacates office under section 6 of the principal Act, continue in office until any person appointed as a successor to that person pursuant to section 4(2)(c) of the principal Act (as substituted by subsection (1) of this section) comes into office.
(3)
Any person who, immediately before the commencement of this section, held office pursuant to section 7(3) of the principal Act as the deputy of any person to whom subsection(2)of this section applies shall, subject to section 7(4) of the principal Act, continue to hold that office.
3 District Walkway Committees
(1)
Section 14(2) of the principal Act is hereby amended by repealing paragraphs (c) and (d), and substituting the following paragraph:
“(c)
Two persons appointed by the Commission on the nomination of the New Zealand Local Government Association Incorporated:”.
(2)
Notwithstanding anything in subsection (1) of this section, where, immediately before the commencement of this section, any person (being a person who was appointed to be a member of a District Walkway Committee pursuant to paragraph (c) or paragraph (d) of section 14(2) of the principal Act) was continuing in office pursuant to section 15(2) of the principal Act, that person shall, unless that person sooner dies or vacates office under section 16 of the principal Act, continue in office until any person appointed as a successor to that person pursuant to section 14(2)(c) of the principal Act (as substituted by subsection (1) of this section) comes into office.
(3)
Any person who, immediately before the commencement of this section, held office pursuant to section 17(3) of the principal Act as the deputy of any person to whom subsection (2) of this section applies shall, subject to section 17(5) of the principal Act, continue to hold that office.
This Act is administered in the Department of Conservation.
