An Act to amend the Toxic Substances Act 1979

BE IT ENACTED by the Parliament of New Zealand as follows:

1 Short Title

This Act may be cited as the Toxic Substances Amendment Act 1988, and shall be read together with and deemed part of the Toxic Substances Act 1979 (hereinafter referred to as the principal Act).

2 Interpretation

Section 2(1) of the principal Act is hereby amended by repealing the definition of the term “proper authority”, and substituting the following definition:

“‘Proper authority’, in relation to a New Zealand port, means the harbourmaster appointed under the Harbours Act 1950 in respect of that port, or any person authorised by the harbourmaster to perform any of the functions of the harbourmaster under this Act:”.

This Act is administered in the Department of Health.
