Contents
An Act to amend the Road User Charges Act 1977
BE IT ENACTED by the Parliament of New Zealand as follows:
1 Short Title and commencement
(1)
This Act may be cited as the Road User Charges Amendment Act 1988, and shall be read together with and deemed part of the Road User Charges Act 1977 (hereinafter referred to as the principal Act).
(2)
This Act shall come into force on the 1st day of April 1988.
2 Interpretation
(1)
Section 2(1) of the principal Act is hereby amended by repealing the definition of the term “Commissioner”
, and substituting the following definition:
“‘Chief executive’ means the chief executive of the Ministry of Transport; and, in relation to any particular function, duty, or power of the chief executive under this Act, includes any person for the time being authorised to exercise or perform that function, duty, or power:”.
(2)
Section 2(1) of the principal Act is hereby amended by repealing the definition of the term “issuing officer”
, and substituting the following definition:
“‘Issuing officer’ means any person or member of a class of persons authorised by the chief executive to act as an issuing officer for the purposes of this Act:”.
(3)
Section 2(1) of the principal Act is hereby amended by repealing the definition of the term “Registrar”
, and substituting the following definition:
“‘Registrar’ means the chief executive; and includes any person for the time being authorised by the chief executive to exercise or perform any of the functions, duties, or powers of the Registrar under this Act:”.
(4)
The following enactments are hereby consequentially repealed:
(a)
So much of section 56 of the Transport (Vehicle and Driver Registration and Licensing) Act 1986 as relates to the definition of the term “Registrar”
:
(b)
So much of the Third Schedule to the State-Owned Enterprises Act 1986 as relates to section 2(1) of the principal Act.
3 References to Commissioner to be read as references to chief executive
The principal Act is hereby amended by omitting the word “Commissioner”
wherever it occurs, and substituting in each case the word “chief executive”
.
4 Restrictions on fitting and repair of hubodometers
(1)
Section 22a(3) of the principal Act (as inserted by section 11(1) of the Road User Charges Amendment Act 1979) is hereby amended by omitting the words “Secretary for Transport”
, and substituting the words “chief executive”
.
(2)
Section 22a of the principal Act (as so inserted) is hereby amended by repealing subsection (4), and substituting the following subsection:
“(4)
Any consent or approval given by the chief executive for the purposes of this section may be given on such terms and conditions as the chief executive thinks fit; and may at any time be varied or revoked by the chief executive by notice in writing to the person.”
This Act is administered in the Ministry of Transport.
