An Act to amend the Coal Mines Act 1979

BE IT ENACTED by the Parliament of New Zealand as follows:

1 Short Title and commencement

(1)

This Act may be cited as the Coal Mines Amendment Act 1988, and shall be read together with and deemed part of the Coal Mines Act 1979 (hereinafter referred to as the principal Act).

(2)

This Act shall come into force on the 1st day of April 1988.

2 Ascertaining whether Crown land may contain coal

(1)

Section 6(1) of the principal Act is hereby amended by omitting the words “the Ministry of Works and Development,”, and substituting the words “the Department of Lands,”.

(2)

Section 6(3) of the principal Act is hereby amended by omitting the words “Ministry of Works and Development”, and substituting the words “Department of Lands”.

3 Land required for coal mine may be taken under Public Works Act 1981

Section 202(2) of the principal Act is hereby amended by omitting the words “or the Minister of Works and Development”.

This Act is administered in the Ministry of Energy.
