An Act to amend the Human Tissue Act 1964
BE IT ENACTED by the Parliament of New Zealand as follows:
1 Short Title
This Act may be cited as the Human Tissue Amendment Act 1989, and shall be read together with and deemed part of the Human Tissue Act 1964 (hereinafter referred to as the principal Act).
2 Interpretation
Section 2(1) of the principal Act is hereby amended by inserting, after the definition of the term “body”
, the following definition:
“‘Health computer system’ means any system of computers and terminals—
“(a)
Under the control of the Director-General of Health; or
“(b)
Part of which is under the control of the Director-General of Health and part of which is under the control of an area health board or a hospital board:”.
3 Removal of human tissue for therapeutic purposes
Section 3 of the principal Act is hereby amended by inserting, after subsection (1), the following subsection:
“(1a)
Where a record of a request in writing to which subsection (1) of this section applies is held on a health computer system, the person lawfully in possession of the body of the person who made the request may, in reliance on the record, unless that person has reason to believe that the request was subsequently withdrawn, authorise the removal from the body of any part or (as the case may be) the specified part for use in accordance with that request.”
This Act is administered in the Department of Health.
