An Act to amend the Offenders Legal Aid Act 1954
BE IT ENACTED by the Parliament of New Zealand as follows:
1 Short Title and commencement
(1)
This Act may be cited as the Offenders Legal Aid Amendment Act 1989, and shall be read together with and deemed part of the Offenders Legal Aid Act 1954 (hereinafter referred to as the principal Act).
(2)
This Act shall come into force on the 1st day of December 1989.
2 Power of Court to grant legal aid to person charged with or convicted of offence
Section 2 of the principal Act is hereby amended by repealing subsection (5), and substituting the following subsection:
“(5)
The power conferred on the Court by this section may be exercised, in accordance with any regulations made under this Act, by—
“(a)
Any Judge:
“(b)
Any District Court Judge:
“(c)
Any Registrar of the Court.”
3 New section (relating to review of decisions of Registrars) inserted
The principal Act is hereby amended by inserting, after section 2, the following section:
“2a Review of decisions of Registrars
“(1)
Any person who is aggrieved by any decision of a Registrar of any Court in the exercise of that Registrar’s jurisdiction under section 2(5) of this Act may apply for a review of that decision to,—
“(a)
Where the decision was made by a Registrar of the Court of Appeal, a Judge of that Court or a Judge of the High Court:
“(b)
Where the decision was made by a Registrar of the High Court, a Judge of that Court:
“(c)
In any other case, a District Court Judge.
“(2)
Every review shall be by way of rehearing of the matter in respect of which the Registrar made the decision.
“(3)
On hearing an application under subsection (1) of this section for a review of a decision of a Registrar, the Judge or District Court Judge may confirm, modify, or reverse the Registrar’s decision.”
