Contents
An Act to amend the Gaming and Lotteries Act 1977
BE IT ENACTED by the Parliament of New Zealand as follows:
1 Short Title
This Act may be cited as the Gaming and Lotteries Amendment Act 1989, and shall be read together with and deemed part of the Gaming and Lotteries Act 1977 (hereinafter referred to as the principal Act).
2 Minister may grant licences to conduct games of chance
Section 8(6) of the principal Act is hereby amended by inserting, after the words “games of chance generally,”
, the words “or to any specified class or classes of games of chance,”
.
3 Maximum penalties increased
(1)
Section 6(2) of the principal Act is hereby amended—
(a)
By omitting from paragraph (a) the expression “$2,000”
, and substituting the expression “$4,000”
:
(b)
By omitting from paragraph (b) the expression “$5,000”
, and substituting the expression “$12,000”
.
(2)
Section 19(2) of the principal Act is hereby amended—
(a)
By omitting from paragraph (a) the expression “$2,000”
, and substituting the expression “$4,000”
:
(b)
By omitting from paragraph (b) the expression “$5,000”
, and substituting the expression “$12,000”
.
(3)
Section 28(2) of the principal Act is hereby amended—
(a)
By omitting from paragraph (a) the expression “$2,000”
, and substituting the expression “$4,000”
:
(b)
By omitting from paragraph (b) the expression “$5,000”
, and substituting the expression “$12,000”
.
4 Amount of promoter’s bond increased
Section 41(1) of the principal Act is hereby amended by omitting the expression “$10,000”
, and substituting the expression “$50,000”
.
5 Secretary to have enforcement role
(1)
Section 53(4) of the principal Act is hereby amended by inserting, after the words “the Police”
, the words “or the Secretary”
.
(2)
Section 59 of the principal Act is hereby amended by inserting in subsection (1), and also in subsection (2), after the word “Police”
in each case, the words “or the Secretary”
.
(3)
Section 60 of the principal Act is hereby amended by omitting from subsection (1), and also from subsection (2), the words “and request the Police”
, and substituting in each case the words “or the Secretary and request the Police or the Secretary”
.
(4)
Section 62(2) of the principal Act is hereby amended by repealing paragraph (c), and substituting the following paragraph:
“(c)
Where the Judge wishes the Police or the Secretary to attend, to the Police or the Secretary.”
6 Change of name of New Zealand Lottery Board
(1)
The Board established by section 116a of the principal Act (as substituted by section 3 of the Gaming and Lotteries Amendment Act 1987) under the name of the New Zealand Lottery Board shall hereafter be called the New Zealand Lottery Grants Board.
(2)
Section 71 of the principal Act (as so substituted) is hereby amended by inserting in the definition of the term “Board”
, after the words “New Zealand Lottery”
, the word “Grants”
.
(3)
Section 116a of the principal Act (as so substituted) is hereby amended by inserting in subsection (1), after the words “New Zealand Lottery”
, the word “Grants”
.
(4)
The First Schedule to the Official Information Act 1982 (as substituted by section 23(1) of the Official Information Amendment Act 1987) is hereby amended by omitting the item “New Zealand Lottery Board”
, and substituting the item “New Zealand Lottery Grants Board”
.
