Pursuant to section 3A(1)(a)(iv) and (b) of the Public Finance Act 1989, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, and being satisfied, at the time of making this order, that more than 50% of the issued ordinary share capital of Crown Fibre Holdings Limited is held by Ministers of the Crown on behalf of the Crown, makes the following order.

This order is the Public Finance (Crown Fibre Holdings Limited) Order 2009.

2 Commencement

This order comes into force on the 28th day after the date of its notification in the Gazette.

3 Schedule 4 of Public Finance Act 1989 amended

Schedule 4 of the Public Finance Act 1989 is amended by—
- (a) inserting, in the first column, the following item in its appropriate alphabetical order: “Crown Fibre Holdings Limited”; and
- (b) inserting alongside that item a tick in each of the columns relating to sections 139 and 150 of the Crown Entities Act 2004.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on the 28th day after the date of its notification in the Gazette, inserts the name Crown Fibre Holdings Limited into Schedule 4 of the Public Finance Act 1989. Adding Crown Fibre Holdings Limited to Schedule 4 means that, under sections 45M and 45N of the Public Finance Act 1989, certain provisions of the Crown Entities Act 2004 apply to the company as if it were a Crown entity under the Crown Entities Act 2004.
